Modifying Your Mortgage and Foreclosures
Mortgages are often one of a family’s greatest sources of debt. When you get behind on a mortgage payment, it can seem like an insurmountable challenge. If the mortgage bank serves you with foreclosure papers, it can be very scary.
I am attorney Peter Scribner, Esq., I have more than 30 years of experience as a bankruptcy lawyer here in New York. I am an industry leader with significant and detailed knowledge.

Were You Referred To Me By The Housing Council?
In the Greater Rochester Area (Monroe County and surrounding counties), the Housing Council at PathStone assists people at risk of losing their homes. Often, the Housing Council sends people to my office knowing I can help. Sometimes they refer cases where someone does not qualify for a mortgage modification. Other times a homeowner is eligible for a mortgage modification but has run out of time and has a foreclosure sale scheduled.
If you are in default on your mortgage, or even if a foreclosure has been started, DON’T PANIC. Mortgage foreclosures take a long time in New York (usually a year or more from when you got behind), and you can, if necessary, file a bankruptcy anytime prior to the foreclosure sale to stop the process.
Once we have filed for bankruptcy, we can stop foreclosure proceedings. From there, we can pay off your mortgage arrears through Chapter 13 or, in some cases, take the time to apply to modify your mortgage.
